Cash Bond or Surety Bond?
If the bail amount is set low enough, you may be able to simply pay it upfront in cash. Provided the defendant has perfect attendance at all court hearings, cash bail will be returned to you, minus court fees, upon completion of the case. If any court date is missed, however, the bail money will be forfeited to the court. The advantage of cash bail is the lack of a premium to pay, but a disadvantage is the lack of any interest earned on the bail money. The court will normally hold the bail money for 90 days, but this period can be even longer if the charge is very serious. Furthermore, if you borrowed the bail money, perhaps on a credit card, interest and fees will pile up while you wait.
A surety or "bail" bond, on the other hand, functions like a check that is held by the court but not cashed so long as the defendant makes all of his court hearings. If the defendant cannot make a scheduled hearing or has already missed it, you should immediately contact the bail bonds company. We can usually work with the court to arrange a new court date and to get the bail bond reinstated. Sometimes, we may have to physically bring the defendant before the judge, but this is a rare scenario. At the close of the case, the judge will exonerate the bond, declaring it null and void and ending all obligations associated with it.
If the judge must issue a bench warrant to re-arrest the defendant, cash bail will almost certainly be lost, but bail bonds can normally be salvaged. This is because bail bonds agencies have the information and resources to ensure the defendant will finally appear in court. Depending on the rules of the local jurisdiction, a bonding agency may even be able to hire a bounty hunter to apprehend a fugitive far faster than police normally can.
